Istruzioni per la cancellazione Diritto di recesso Il cliente ha il diritto di recedere dal contratto entro 30 giorni in forma scritta (ad es. lettera, fax e-mail), senza obbligo di indicazione della motivazione oppure, nel caso in cui la merce venga rilasciata prima della scadenza del termine, restituendo la merce. Il periodo di 30 giorni inizia dalla ricezione di questa informativa in forma scritta, tuttavia non prima del ricevimento della merce (in caso di nuova spedizione dello stesso articolo non prima della prima consegna) e comunque non prima che da parte nostra si sia adempiuto ai nostri obblighi di informazione in conformità all'articolo 246 § 2 in associazione al § 1 comma 1 e 2 EGBGB - Codice Civile della Repubblica Federale di Germania. Nel caso in cui la prestazione ottenuta non possa esserci ritornata completamente e/o parzialmente oppure possa esserci ritornata solo in stato completamente e/o parzialmente deteriorato, il cliente è tenuto a rimborsarci di conseguenza. Nel caso di cessione di merce, ciò non si applica, se il deterioramento della merce è riconducibile solo alla sua ispezione, come invece sarebbe possibile effettuare in un negozio fisico. In generale il cliente può sottrarsi all'obbligo di rimborso per il deterioramento della merce, sorto durante l'utilizzo in ottemperanza alle disposizioni, se rinuncia ad utilizzare la merce stessa come se fosse di sua proprietà e non commette azioni che potrebbero causarne danni e pregiudicarne il valore. Merci che possono essere imballate e spedite come pacchetto via posta sono da rispedirci a nostro rischio. Il cliente è tenuto a sostenere le spese per la spedizione del reso, se la merce consegnata corrisponde a quanto ordinato. Oggetti non inviabili per posta come pacchetti saranno ritirati dal cliente. Gli obblighi riguardanti il rimborso dei pagamenti vanno rispettati entro 30 giorni. Questo periodo ha inizio per il cliente con la spedizione della richiesta di reso, per noi dal ricevimento della stessa. Fine dell'informativa sul diritto di recesso 2. Il diritto di recesso non si applica per merci eseguite su richiesta del cliente (ad es. pellicola di protezione display con le misure indicate dal cliente) oppure evidentemente confezionate in base alle richieste del cliente oppure per la fornitura di registrazioni audio e/o video o di software, nel caso in cui il relativo supporto dati sia stato aperto dal cliente. 3. Il cliente è pregato di evitare di causare danni o di sporcare. È inoltre pregato di rispedire la merce possibilmente nella confezione originale con tutti gli accessori e le parti costitutive della spedizione. È invitato a utilizzare un sovra-incarto di protezione. Se non dovesse più essere in possesso della confezione originale, è invitato a procurarsi un imballaggio adeguato per evitare danni dovuti al trasporto. 4. Il cliente è pregato di rispedire la merce assicurata nel modo meno costoso possibile. Siamo disponibili ad anticipare i costi di spedizione, se questi sono a carico del cliente. 5. Il cliente è pregato di mettersi in contatto con noi telefonicamente al numero 49 (7531) 1273863 prima della spedizione, per informarci della stessa. In questo modo potremo organizzare al meglio il reso. 6. Le modalità citate nei paragrafi dal 6.3 al 6.5 non costituiscono prerequisito per poter godere appieno del diritto di resa.
